Welcome to shreddedgoose.com (“Shredded Goose”, “we”, “us”, “our”). By accessing or using our website, services, features, or Marketplace (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1. Use of the Service
You must be at least 13 years old to use the Service. To create listings or participate in buying or selling through the Marketplace, you must be at least 18 years old.
You agree to use the Service lawfully and not to:
Violate any applicable laws or regulations
Abuse, harass, or harm other users
Post false, misleading, or fraudulent listings
Attempt to gain unauthorised access to systems or data
Upload malicious code or misuse the platform
We reserve the right to suspend or terminate access if these rules are violated.
2. Accounts
You are responsible for maintaining the security of your account and all activity that occurs under it.
3. User Content
You retain ownership of content you submit, including Marketplace listings, images, and descriptions. By submitting content, you grant Shredded Goose a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute such content as part of the Service.
You are solely responsible for your content and any consequences arising from it.
4. Community Guidelines
Shredded Goose is a community platform. Respect other users. We may moderate or remove content, suspend accounts, or take action we deem necessary to maintain a safe and constructive environment.
5. Marketplace
Shredded Goose provides a user-generated marketplace (“Marketplace”) where users may list, buy, and sell dirt bikes, gear, parts, and related items.
5.1 Platform Role
Shredded Goose acts solely as a venue for users to post listings and connect with one another. We are not the seller or buyer of any listed item. We do not own, inspect, verify, certify, guarantee, or control any listings or items offered for sale.
All transactions occur directly between users at their own risk.
5.2 No Mediation
We do not mediate disputes between buyers and sellers. We are not responsible for resolving payment disputes, delivery issues, fraud claims, mechanical defects, or any transaction-related conflicts.
5.3 Listings & Representations
By posting a listing, you represent that:
You own the item or are authorised to sell it
The item is not stolen or unlawfully obtained
All information provided is accurate and truthful
5.4 Prohibited Listings
The following may not be listed:
Stolen property or tampered VIN vehicles
Illegal or prohibited items
Counterfeit or fraudulent goods
Listings intended to scam or mislead users
We reserve the right to remove any listing at our sole discretion.
5.5 “As-Is” Sales
All items are sold “as is” unless otherwise agreed directly between users. Shredded Goose makes no warranties regarding condition, safety, legality, authenticity, or functionality of any item.
5.6 Safety
Users are responsible for taking appropriate safety precautions when meeting in person or conducting transactions. We recommend meeting in public places and verifying the identity of the other party before exchanging payment or goods.
6. Third-Party Services
The Service may include third-party services, links, or integrations. We are not responsible for third-party content, services, or privacy practices.
7. Advertising
We may display advertisements on the Service. Advertisements may be personalised or non-personalised depending on your cookie consent preferences. They can also take the form of boosted (aka featured) content by users for increased visibility. We do not endorse or guarantee any advertised products or services. Advertisers are solely responsible for their ads and any claims arising from them.
8. Disclaimer
The Service is provided “as is” and “as available”. We make no warranties regarding accuracy, reliability, or suitability for any purpose. Use of the Service is entirely at your own risk.
9. Indemnification
You agree to indemnify and hold harmless Shredded Goose, its owner, and affiliates from any claims, damages, liabilities, losses, or expenses arising out of:
Your use of the Service
Your Marketplace listings or transactions
Your violation of these Terms
Any dispute between you and another user
10. Limitation of Liability
To the fullest extent permitted by law, Shredded Goose shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including financial loss, property damage, personal injury, or losses arising from Marketplace transactions.
We are not responsible for fraud, misrepresentation, non-payment, delivery failures, mechanical defects, or disputes between users.
11. Termination
We may suspend or terminate your access at any time if you breach these Terms or misuse the Service. You may stop using the Service at any time.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from the Service shall be subject to the jurisdiction of South African courts.
13. Changes
We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
15. Event Module Terms
The following terms apply to event organisers who activate specific modules on the platform.
Tickets Module - Terms & Conditions
1. Overview
By activating the Tickets Module you agree to provide accurate contact and banking information and accept full responsibility for managing your event ticketing through this platform. These terms govern the relationship between you (the event organiser) and the platform operator.
2. Payment Processing & Fees
All ticket revenue collected through the platform will be processed by our payment provider. Platform service fees and commission percentages (as configured per event) will be deducted prior to disbursement. You acknowledge that payouts are subject to the platform's standard settlement schedule and that refunds or chargebacks are your responsibility.
3. Organiser Obligations
You are responsible for accurate event information, pricing, and availability displayed on your ticket listings. You must honour all valid tickets issued through the platform and ensure attendees can access the event as advertised. Any fraudulent activity will result in immediate suspension of this module.
4. Data & Privacy
Attendee contact details collected during ticket purchase will be shared with you solely for the purpose of managing this event. You agree not to use this data for any unrelated marketing or third-party purposes without explicit attendee consent, in accordance with applicable privacy legislation.
5. Cancellations & Refunds
In the event of cancellation, postponement, or material change to the event, you are obligated to issue refunds to ticket holders in accordance with consumer protection laws. The platform may facilitate refund processing but final responsibility rests with you as the event organiser.
6. Liability
The platform provides ticketing infrastructure as-is. We are not liable for losses arising from technical issues, delayed payouts, or third-party payment failures beyond our reasonable control. Your use of this module constitutes acceptance of these terms.
Registration Module - Terms & Conditions
1. Overview
By activating the Registration Module you agree to provide accurate contact and banking information and accept responsibility for managing participant entries through this platform. These terms govern the relationship between you (the event organiser) and the platform operator.
2. Entry Fees & Payments
All entry fees collected through the platform will be processed by our payment provider. Platform service fees and commission percentages (as configured per class or entry type) will be deducted prior to disbursement. You acknowledge that payouts follow the platform's standard settlement schedule.
3. Organiser Obligations
You are responsible for accurately setting class requirements, entry limits, pricing, and any age or vehicle restrictions. You must honour all valid registrations submitted through the platform and ensure participants can compete or participate as described.
4. Participant Data
Participant data including personal details, vehicle information, and entry status collected during registration will be accessible to you solely for event management purposes. You agree not to use this data for marketing or third-party purposes without explicit participant consent.
5. Cancellations & Refunds
Should you cancel, postpone, or materially change the event after participants have registered and paid, you are obligated to issue appropriate refunds. The platform may facilitate this process but liability remains with you as the event organiser.
6. Safety & Compliance
You remain solely responsible for the safety of all participants at your event and for compliance with applicable sporting association regulations, local by-laws, and insurance requirements. Activating this module does not imply platform endorsement of your event's safety standards.
